Security Requirements and Health Conditions for Adventure Activities
At Catalonia Adventures, your safety and well-being are our highest priority. For this reason, before booking any adventure activity, such as bungee jumping, climbing routes, via ferratas or cave descents, it is essential that you provide full and honest information about any physical limitations, medical conditions or psychological states that could affect your safety. These conditions are fundamental to ensure that each activity is carried out in an optimal safety environment and that the standards established by both Spanish legislation and current European regulations are met.
Obligation to Communicate Health Conditions
Before making the purchase or booking your activity, the client must inform us of any condition such as cardiovascular diseases, respiratory problems, mental disorders or other ailments that may increase the inherent risks of high-intensity activities. This information must be communicated in advance to our team of guides, either through the online booking form or directly before the start of the activity. The aim is for our professionals to assess the situation and, if necessary, adapt the activity or recommend a more suitable alternative based on your needs.
In compliance with Article 22 of Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), and in accordance with Regulation (EU) 2016/679 (GDPR), the client guarantees that all information provided is truthful and complete. If this information is not shared, the client assumes full responsibility for the risks arising from their participation in the activities. Likewise, the client expressly exempts Catalonia Adventures from any claims or liability resulting from the failure to disclose conditions that may affect their safety or the development of the activity.
Mandatory Adherence to Safety Guidelines
All participants must strictly follow the safety guidelines and instructions provided by our guides. These directives have been designed in accordance with established safety standards and are intended to minimize the inherent risks of activities such as bungee jumping, climbing, via ferratas or cave descents. In this sense, Catalonia Adventures assumes no responsibility in the event of accidents, injuries or damages arising from ignoring or improperly handling the safety instructions.
According to Article 19 of Royal Legislative Decree 1/2007 on the Defense of Consumers and Users, the client must accept that participation in these activities involves a certain level of risk, which must be managed by strictly following the guidelines set by our professional team. Therefore, if the user decides not to follow these instructions, they do so at their own risk, exempting the company from any responsibility or claims that may arise as a consequence of this behavior.
Increased Risk in Case of Non-Disclosure
Catalonia Adventures reserves the right to deny access to any activity to those clients who do not meet the minimum health and safety requirements. This preventive measure is designed to preserve the safety of all participants and to avoid incidents that may endanger the physical and emotional integrity of users. If, for example, a client does not disclose conditions such as arrhythmias, hypertension, severe respiratory problems or psychological disorders that may affect their participation, and an incident occurs during the activity, the responsibility will fall solely on the client, who will have expressly waived the right to make any claim against Catalonia Adventures.
This aspect is fundamental to our safety policy, as compliance with instructions and transparency in communicating personal conditions are key to reducing any risk in adventure activities. For this reason, the client must expressly accept, at the time of booking, that they have provided completely honest information about their health status and that they commit to following the guides’ instructions during the activity. This declaration is reflected in the booking form, where the client is asked to confirm that they have no physical limitation or condition that may prevent them from carrying out the activity.
Additional Safety Measures and Preliminary Assessment
To strengthen safety, before starting any activity, our team of guides carries out a preliminary assessment that includes a brief interview with the participants to ensure that everyone is in optimal condition to participate. If any condition is observed or reported that may increase risks, the guide will immediately inform the client about the advisability of modifying, postponing or, if necessary, denying access to the activity. This assessment is not only based on the previously provided information but also includes direct observation of the behavior and physical condition of the participants at the start of the activity.
In addition, in cases where potentially dangerous health conditions are detected, our guides may recommend that participants consult their doctor before participating. These planned measures are essential to ensure that each activity takes place in a controlled environment, with minimal risk to participants. Likewise, Catalonia Adventures commits to providing detailed information on the health conditions required for each activity, including specific warnings for high-intensity activities such as bungee jumping or climbing.
Liability Waiver in Case of Non-Compliance
In the event that a client does not provide complete information about their health status, or in the event that they do not follow the safety guidelines established by the team of guides, Catalonia Adventures will be exempt from any liability related to damages or injuries that may arise from this lack of communication or failure to follow instructions. This liability waiver is based on the need to protect the physical and emotional integrity of the participants and on the company’s right to ensure general safety during the activity.
The client acknowledges that participating in adventure activities involves a certain level of inherent risk, and that compliance with safety guidelines and the communication of any personal condition are essential to minimize this risk. In this sense, the client agrees that, if an accident or incident occurs due to their failure to communicate or disobedience of the safety instructions, they will not be able to claim compensation or hold Catalonia Adventures responsible. This includes any claim resulting from injuries, material damage or emotional damage that may occur during participation in the activities.
Client’s Statement of Responsibility
The client commits to providing completely honest and detailed information about any condition that may affect their participation in adventure activities. This information is fundamental in order to adapt the activities to individual needs and to ensure the safety of all participants. If the client omits this information or provides inaccurate data, they do so under their own responsibility, exempting Catalonia Adventures from any consequence resulting from this failure to comply.
Furthermore, by booking and participating in any activity, the client acknowledges that they have read and understood all established health and safety conditions and that they commit to following the instructions and safety guidelines dictated by our guides. The client understands that these measures are necessary to protect their health and that of the other participants, and that any deviation may represent a high risk, for which reason they commit to acting responsibly and prudently at all times.
In Summary
Catalonia Adventures works constantly to offer adventure experiences that are both thrilling and safe. To achieve this goal, it is essential that clients comply with the safety requirements and report any condition that may affect their participation. These planned measures not only protect the health of the participants, but also ensure that each activity is carried out in a rigorous safety framework, minimizing the inherent risks of adventure activities.
Compliance with these conditions is essential to ensure a high-quality adventure experience. By booking the services of Catalonia Adventures, the client expressly agrees that their participation takes place under their own responsibility and that they have been informed of the importance of communicating any relevant health condition. Likewise, the client exempts Catalonia Adventures from any liability resulting from the lack of communication or failure to comply with the safety guidelines.
This mutual commitment is essential to ensure that each activity is carried out safely, responsibly and in full compliance with current Spanish and European regulations.
